1. Liability and Termination

Liability: The Driver is liable for any loss caused to autorout.in due to negligence or unlawful acts during service. autorout.in is not responsible for any direct or indirect loss resulting from a Customer's failure to show up within the agreed time, even if such timing was previously agreed upon.

Termination of Driver Registration:

  1. General Termination: Either party may terminate these Terms and Conditions (T&C) with a written notice of 7 (seven) business days without providing a reason.
  2. Termination for Breach: If a breach of obligations, representations, or warranties occurs, the non-breaching party can terminate the T&C after 5 (five) days from notifying the breaching party if the breach is not rectified within this period.
  3. Effects of Termination: Upon termination:
    • The Driver's registration and account on the portal will be canceled.
    • The Driver must pay any outstanding amounts to autorout.in.
    • autorout.in may return any subscription fees with deductions for amounts due or penalties.
    • autorout.in will settle any due Driver proceeds for services completed before termination.
    • Both parties must return or destroy any property, materials, or confidential information provided under these T&C.
    • The Driver must cease using any autorout.in branding or uniforms and all marketing and other related activities.
  4. Survival of Clauses: Clauses relating to content, privacy, disclaimer, confidentiality, indemnification, termination, dispute resolution, governing law, and jurisdiction will survive termination.
  5. Rights and Remedies: Termination does not affect any rights or remedies accrued prior to termination or limit any additional remedies available to autorout.in.

2. Dispute Resolution, Governing Law, and Jurisdiction

  1. Dispute Resolution: Disputes between the Driver and autorout.in will be resolved through arbitration under the Arbitration and Conciliation Act, 1996, with proceedings conducted in Bangalore in English. The arbitrator's decision will be final and binding.
  2. Governing Law: These T&C are governed by the laws of India.
  3. Jurisdiction: Exclusive jurisdiction for any legal matters related to these T&C will lie with the courts in Bangalore.
  4. Equitable Relief: autorout.in may seek interim injunctions or other equitable relief as necessary to prevent violations of the T&C.

3. Miscellaneous

  1. Entire Agreement: These T&C, along with the Subscription Agreement, policies, and any other documents notified by autorout.in, constitute the entire agreement and supersede all prior communications.
  2. Independent Contractor: The Driver is an independent contractor and not an employee or agent of autorout.in. autorout.in is not responsible for payroll taxes or benefits.
  3. Assignment: The Driver cannot assign their rights or obligations without autorout.in's written consent. autorout.in may assign its rights or obligations at its discretion.
  4. Force Majeure: Delays or failures in performance due to force majeure events (e.g., government actions, natural disasters) are not considered defaults. The affected party must notify the other party within 7 days and make reasonable efforts to resume performance.
  5. Notices: Notices should be sent by:
    • Email: info@autorout.in for autorout.in, and as provided by the Driver.
    • Hand delivery or registered mail to the addresses provided.
  6. Waiver: No delay or failure in exercising rights under these T&C will be considered a waiver of those rights.
  7. Severability: Provisions that are prohibited or unenforceable will not invalidate the remaining terms.
  8. Amendment: autorout.in may amend these T&C at its sole discretion.

4. Zero Tolerance Policy

Drivers must adhere to the Zero Tolerance Policy, which is subject to change. Key points include:

  1. Prohibition on Tips: Drivers must not ask for tips or hassle customers for change.
  2. Time Management: Personal stops are not allowed during the trip.
  3. Hygiene: Drivers must wear neat uniforms and maintain personal hygiene.
  4. Customer Service: Greet customers, handle luggage, and manage vehicle cleanliness.
  5. No Disturbances: Avoid loud music, unnecessary horn use, and personal conversations.
  6. No Smoking: Smoking or chewing food items in the vehicle is prohibited.
  7. Change Availability: Drivers must have adequate change.
  8. Contact Protocol: Drivers should not make unnecessary calls or misuse customer contact details.
  9. Route Knowledge: Drivers should avoid long routes and be familiar with routes.
  10. Pick-Up Timeliness: Arrive early and notify customers upon arrival.
  11. Mobile Phone Use: Limited to emergencies, excluding use during driving.
  12. Reporting: Accurate reporting of vehicle positions and meter readings is required.
  13. Speed Limits: Adhere to speed limits and avoid rash driving.
  14. Documentation: Carry all necessary documents, including driving licenses.
  15. Vehicle Use: Do not sleep in the vehicle without customer consent.
  16. Booking Acceptance: Rejection of bookings is not permitted without authorization.
  17. Device Use: Ensure proper use of any provided devices.
  18. Traffic Rules: Comply with all traffic laws and wear seat belts.
  19. Route Integrity: Follow the best route and avoid fare manipulation.
  20. Substance Abuse: No driving under the influence of alcohol or narcotics.
  21. Customer Interaction: Maintain respectful behavior and avoid discrimination.
  22. Inconvenience: Do not end trips mid-journey without valid reasons.
  23. Brand Image: Avoid actions impacting autorout.in’s brand negatively.
  24. Vehicle Weight: Adhere to the manufacturer's weight limits.
  25. Medical Fitness: Do not drive if health conditions affect driving.
  26. Unauthorized Goods: Do not accept bookings for unauthorized purposes.

5. Information We Collect

Personal Information: We collect personal information that you provide directly to us, such as your name, email address, phone number, address.
Usage Data: We collect information about your interactions with our app, including your IP address, device type, operating system.
Legal Requirements: We may disclose your information if required by law or to protect our rights and safety.

We access Driver's real-time location to facilitate vehicle pickups, drop-offs, and live ride tracking for service centers and vehicle owners. The driver location data is encrypted and securely stored. We do not share the location data with any third-party.

Third-Party Service Providers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.
Business Transfers: We collect information about your interactions with our app, including your IP address, device type, operating system, and browsing behavior.
